Summing Up Recent Insurance Department Rulemaking Proceedings

In the last few months, the New Hampshire Insurance Department has initiated numerous administrative rulemaking proceedings, including:

Ins 1908 Coverage for Individuals Under the Age of 19 – addresses the availability of individual insurance in the voluntary market for children under 19 years of age. Current Status: Insurance Department public hearing held 04/28/11.

Ins 3000 Financial and Health Information Privacy – governing the treatment of nonpublic personal health information and nonpublic personal financial information about individuals. Current Status: Adopted:  04/29/11; Effective:  05/06/11.

Ins 4100 Requirements for Accident and Health Insurance Rate Submissions – reorganizes and updates the requirements for all filings of accident and health insurance rates by coverage type. Current Status: JLCAR Meeting 05/20/11

Ins 312 Life Insurance Disclosures – establishes standards for the annual disclosure by life insurers to policyholders pursuant to RSA 408-D:8 (life settlement). Current Status: JLCAR Meeting 05/20/11.

Ins 2900 – Hazardous Financial Conditions – NAIC model originally adopted September 1992; this proceeding incorporates latest NAIC model language providing commissioner with additional standards to deem hazardous financial conditions, and additional remedies to deal with such conditions. Current Status: JLCAR Meeting 05/20/11.
